US participation in Eulex Kosovo endorsed by agreement
(B2) The European Union will affix its signature to the participation of the Americans in the civilian mission Eulex (rule of law) in Kosovo.
A symbolic event in more ways than one. Avec l'agreement with the Russians for Eufor Tchad, it is first and foremost proof of Europe's ability to bring together different partners, sometimes opposed on the international scene, on diferent operations. European diplomacy thus proves its readiness to pursue a policy of multiple alliances. This can only strengthen - at the global level - its credibility as an alternative force. Finally (small satisfaction), it will thus be the first time that Americans will come under European (EU) command in an ESDP operation.
The content of the agreement is fairly standard in this type of operation (similar agreements have already been made with the Switzerland and Croatia). "The United States has the same rights and obligations in terms of day-to-day management of the operation as participating EU member states." They bear all the costs associated with the operation - "unless they are subject to joint financing". The United States ensures in particular that its seconded personnel "carry out their mission in accordance with the joint action (European) 2008/124/PESC and its subsequent modifications, the operation plan of Eulex Kovoso".
The passage of the Americans under European command is clear. “The Head of Mission exercises command and control of the personnel, teams and seconded units provided by the contributing States”. He is notably "responsible for matters of discipline". With two reservations (again classic): On the one hand, "any disciplinary measure (remaining) the responsibility of the United States". On the other hand, the status of seconded personnel falls under the "exclusive jurisdiction" of the United States.
